The taks of this paper is to present a theory of reflexive law appropriate for universal claim of law in modern pluralistic society. It is an outstanding of Jurgen Hambermas to have developed for us an ethical theory proper for universal lawmaking process that is dicourse ethics. In discourse ethics conflicts of action are settled by consensus. The agreement reached is trully reflexive in nature and expresses a general interest or common will because it is brought by a real process of argumentation where social agents concerned cooperate. The general will takes on a moral quality because the judgment alms at universality and imparatiality.
